Pursuant to Article 13(1) and (2) of the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, OJ EU L.2016.119.1), we hereby inform you that:

  1. The controller of your personal data processed in the recruitment process is ZAKŁAD WŁÓKIENNICZY BILIŃSKI SPÓŁKA JAWNA, Tax ID (NIP) 7272720924, UL. MICKIEWICZA 29, 95-050 KONSTANTYNÓW ŁÓDZKI.
  2. The Controller has appointed a Data Protection Officer, whom you can contact at: iod@farbiarniabilinski.pl
  3. Your personal data will be processed for purposes related to recruitment, the legal basis being primarily Article 6(1)(c) in connection with Article 22¹ of the Labour Code, as well as Article 6(1)(a) of the GDPR, i.e. consent to the processing of personal data contained in your CV or in other documents you provide to the employer that are not expressly required by labour law. With regard to personal data processed on the basis of consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal. The Controller will also process your personal data in future recruitment processes if you consent to this, which consent may be withdrawn at any time. If the documents contain data referred to in Article 9(1) of the GDPR, your consent to their processing will be required, which may be withdrawn at any time.
  4. The recipients of your personal data may be entities processing data on our behalf under a data processing agreement, cooperating entities, and entities obliged to do so by law. Your personal data will not be transferred to a third country or an international organisation.
  5. Your personal data will be processed for the duration of the recruitment, no longer than 3 months from the date of the recruitment announcement. If you have consented to the use of your personal data for future recruitment purposes, your data will be used for a period of 2 years.
  6. You have the right to access your data and to rectify, erase or restrict its processing, or to data portability, in the cases specified in the GDPR.
  7. During the processing of your personal data, there is no solely automated decision-making or profiling as referred to in Article 22(1) and (4) of the GDPR. This means that no decisions concerning the Candidate will be made solely automatically, and no profiles are built.
  8. If you consider that the processing of personal data infringes applicable law, you have the right to lodge a complaint with the supervisory authority, which in Poland is the President of the Personal Data Protection Office.
  9. Providing your personal data for employment purposes to the extent resulting from Article 22¹ of the Labour Code is necessary in order to participate in the recruitment process; without processing it, conducting the recruitment and employment would not be possible. Providing other data is voluntary.

Right of access by the data subject

  1. The data subject shall have the right to obtain from the administrator confirmation as to whether personal data concerning him or her are being processed and, where that is the case, access to the personal data and the following information:
    1. the purposes of the processing;
    2. the categories of personal data concerned;
    3. information about the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
    4. where possible, the envisaged period for the storage of personal data and, where that is not possible, the criteria for determining that period;
    5. information about the right to request from the administrator rectification, erasure or restriction of the processing of personal data concerning the data subject and to object to such processing.
    6. information about the right to lodge a complaint with a supervisory authority;
    7. if the personal data have not been collected from the data subject, any available information about their source;
    8. information about automated decision-making, including profiling, referred to in art. 22 item 1 and 4, and – at least in these cases – relevant information about the principles of their taking, as well as the significance and expected consequences of such processing for the data subject.
  2. If personal data are transferred to a third country or an international organisation, the Data Subject shall have the right to be informed of the appropriate safeguards referred to in Article 46, related to the transfer.
  3. The administrator shall provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the administrator may charge a reasonable fee based towards administrative costs. Where the data subject makes the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.
  4. The right to obtain a copy referred to in item 3, shall not adversely affect the rights and freedoms of others.
